New Computer Warranty
Throughout this document these terms shall have the following meanings:
"We", "us", and "our" shall refer to the "CWSL" (Computer Works of Sylvan Lake, Inc.). "You" and "Your" shall refer to you the purchaser. "The Plan" shall refer to this document along with Your sales receipt or Invoice for the Covered Product.
All New Computer Works of Sylvan Lake, Inc.'s (CWSL) Pro, Xtreme & custom configured Desktop Computer Systems are covered with a two-year Parts & Labor warranty unless otherwise specified on your invoice. (The two year warranty began on February 1, 2007) All Value systems are covered by a one-year Parts & Labor warranty. The warranty covers all hardware parts and does not cover any software issues such as viruses, Spyware, malware and any other software issues that may arise during the course of ownership. The warranty will not cover software issues that are caused due to the failure of any hardware whether internal or external. The warranty coverage commences as of "notice of completion" of the system, not when system is "picked up" from our retail location. Hardware part is defined as all components within the computer case only and excludes all peripherals.
During the two year warranty period if any internal part should fail, CWSL will replace such part with an exact or equal part if available. If an exact or equal part is not available we will replace with an upgraded part at no expense to customer. "Same Day Priority Service" (restrictions apply) is included during the two year warranty. This warranty does NOT cover any software issues. (Please read below)
New Monitors and other peripherals purchased from CWSL will carry a 30 Day Exchange Warranty. The monitor may have a Manufacturers warranty, in which case CWSL will handle the warranty claim for the customer during the first 90 days of CWSL’s warranty period; the customer will be responsible for all packaging and shipping charges. After the first 90 days, please contact the manufacturer directly for repair or replacement.
The labor warranty is strictly limited to any labor associated with any defects in material and/or workmanship of any internal computer hardware part. This coverage starts the day that the item is purchased. Any modification of the hardware configuration not performed by CWSL or a certified Technician will invalidate this warranty. Computer Works of Sylvan Lake, Inc. warrants all CWSL branded new computer systems purchased from us to be free of defects in materials or workmanship that occur during normal use for a period of one to two calendar year from date of purchase (depending on the type of system purchased). This warranty applies only to the original purchaser ("Customer") and is not transferable. CWSL will repair or replace original parts for free during the warranty period at the CWSL location on 3377 Orchard Lake Rd. in Keego Harbor, MI 48320, (248) 738-8700. The customer is responsible for transportation of computer to CWSL for warranty service. Repair parts and replacement products shall be furnished at our discretion on an exchange basis and shall be either new or reconditioned. All replaced parts and products shall become our property. Under the 1-2 year hardware parts Warranty, coverage will not apply to defects or damage resulting from:
- Software viruses, corrupted software or data, or any other software problem;
- Disasters such as floods, fires, winds, earthquakes, or lightning;
- Failure to provide the proper installation environment;
- Peripherals or unauthorized attachments;
- Service by an unauthorized service center;
- Any other type of abuse, misuse or neglect;
- The serial number, the "white sticker" being removed, defaced or altered
- Damage from 3rd party devices (including add on cards or drives not installed by a certified Technician
- Improper packing during return shipment to us;
CWSL disclaims all other warranties not stated herein; expressed or implied, including without limitation implied warranties of merchantability and fitness for a particular purpose. CWSL’s responsibility for warranty claims is limited to repair and replacement as set forth herein. CWSL reserves the right to modify its warranty at any time, at its sole discretion. CWSL does not accept liability beyond the remedies set forth herein, including any liability for systems not being available for use, or for loss or corrupted data or software. CWSL will not be liable for lost profits, loss of business or other consequential, special, indirect or punitive damages, even if advised of the possibility of such damages, or for any claim by any third party.
IT IS THE CUSTOMER’S RESPONSIBILITY TO BACK UP ALL DATA.
In all cases, the customer’s sole remedy for a product failure is limited to a replacement product.
Extended Warranty
Extended warranties can only be purchased within 30 days of purchasing system. Once purchased, no refunds or partial refunds can be given at any time. Warranties are not transferable. Warranties are strictly for Carry-In Service only. Extended warranties are strictly for repair/replacement due to manufacturer defect. They do not cover software issues of any kind.
Extended Warranty Coverage
The Carry-In Repair Plan will pay for labor and replacement parts required to keep your covered product in normal operating condition as specified in the terms of this Plan. If your covered product requires service because of a product failure during normal usage, "CWSL" has the option to repair or replace the defective product with a like product of equal or similar features, specifications, and functionality. Replacement parts may be new or reconditioned of like kind and quality. Damage or defects to your covered product caused by a power surge will be covered up to $100.00 for the life of the Carry-In Repair Plan. Your product must be carried in to COMPUTER WORKS OF SYLVAN LAKE, INC. to obtain service under this Plan. On-site coverage and shipping charges will not be provided.
The specific Plan, which you purchased, is incorporated within the Invoice. "CWSL" will cover labor and parts necessary to restore your product to normal operating condition if it becomes inoperable during the term of your coverage and subject to the terms, conditions, limitations, and exclusions of the specific plan you purchased as listed below. The Plan for your desktop computer (CPU) is incorporated within the invoice and covers the following system components as included in the original configuration by the manufacturer: motherboard and all components resident on the motherboard, internal power supply, up to two floppy drives including Zip, Jazz and other similar drives, 1 hard disk drive, all internal cards, 1 CD-ROM drive, 1 DVD drive, 1 CD-RW drive, 1 tape drive. The monitor is included in your Plan if purchased at the same time as your desktop computer (CPU). However shipping charges to the manufacturer are not covered. LCD or FLAT PANEL monitors must have at least 8 dead pixels to eligible for CWSL coverage. Coverage excludes peripherals, purchased at time of sale, that are not part of the original configuration by the manufacturer, such as joysticks, scanners, external/internal drives and other similar equipment.
Exclusions From Coverage
The following is applicable to all Plans: "CWSL" is not obligated to repair or replace cosmetic or structural items; damage, warping or rusting of any kind to the housing, case or frame of the product or any non-operating part, including plastic, or decorative parts; or parts normally designated to be replaced periodically by you or consumed during the life of the product (i.e., batteries, ribbons, toner cartridges, drums, etc.). In no event shall "CWSL" be liable for consequential damages including but not limited to any delay in rendering service under the Plan, for loss of data, or for loss of use during the period that the product is at a repair center or otherwise awaiting parts. You are responsible for backing up all computer software prior to commencement of any repairs. "CWSL" is not responsible for restoring software to your product. If your product experiences a defect or damage that is excluded from coverage under this section or in the event that no covered defect or damage is found, then you are responsible for all repair costs, parts, and the cost of on-site service, if any.
Disclaimer of Certain Liabilities
Under no circumstances shall the retailer, the service facility, "CWSL", consequential, or incidental damages (including damages for lost profits, business interruption, loss of data, and the like), even if any party has been advised of the possibility of such damages. The Plan will not cover any defects that are subject to a manufacturer’s warranty or program of reimbursement. The Plan is not a warranty or insurance policy; it is a Service Contract and is not intended to create or limit any implied warranties concerning your product which may or may not exist under applicable state or federal law.
